Terms of Service
These Terms of Service ("Terms") govern your access to and use of Lathyrus Trading's website, Discord community, live sessions, courses, and related services (collectively, the "Services"). By accessing or using the Services, you agree to be bound by these Terms. Please read them carefully alongside our Privacy Policy and Risk Disclosure.
1. Acceptance of Terms
By creating an account, subscribing to a membership, joining our Discord server, or otherwise accessing any part of the Services, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree with any part of these Terms, you must not use the Services.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract in your jurisdiction to use the Services. The Services are not intended for or directed at minors. By using the Services, you represent and warrant that you meet these requirements and that your use of the Services does not violate any law or regulation applicable to you.
3. Our Services
Lathyrus Trading is an educational platform and community focused on price action, market structure, and trading strategy. The Services may include:
Live trading streams, market commentary, and New York session sessions
Pre-recorded lectures, courses, and learning materials
A private Discord community with mentor and instructor access
Trading models, frameworks, and analytical tools
Periodic backtesting sessions, Q&A, and personal feedback
All content is provided for educational and informational purposes only. The availability, features, and scope of the Services may change at any time without notice.
4. Accounts and Membership
To access paid Services, you must register and subscribe through our third-party processor, Whop. You are responsible for maintaining the confidentiality of your login credentials, for all activity that occurs under your account, and for notifying us immediately of any unauthorized access or suspected breach.
Accounts are personal, non-transferable, and limited to a single user. Sharing credentials, recordings, course material, or private Discord content with any non-member is strictly prohibited and may result in immediate termination of your account without refund.
5. Payments, Billing, and Whop
All payments, subscriptions, and billing for paid memberships are processed by Whop Inc. ("Whop"), our third-party payment processor. By purchasing a Lathyrus Trading membership, you also agree to Whop's Terms of Service and Privacy Policy, available at whop.com. Lathyrus Trading does not store, process, or have access to your payment card details; all payment information is handled securely by Whop.
Subscription fees are charged in advance on a monthly or quarterly basis depending on the plan selected.
Prices are listed in USD unless otherwise stated and exclude any applicable taxes, which are your responsibility.
Your subscription automatically renews at the end of each billing cycle until cancelled.
We reserve the right to change pricing for future billing cycles; existing subscribers will be notified prior to any change taking effect at renewal.
6. Cancellation and Refunds
You may cancel your subscription at any time through your Whop account dashboard. Cancellation takes effect at the end of your current billing period, and you will retain access to the Services until that date.
All sales are final. Given the digital, educational, and immediately-accessible nature of our Services, we generally do not issue refunds for partial billing periods, unused time, or change of mind. Any refund request must be submitted in writing and will be evaluated on a case-by-case basis at our sole discretion.
Chargebacks initiated without first contacting us will be contested and may result in permanent termination of your account and any associated access.
7. No Investment, Financial, or Professional Advice
Lathyrus Trading is an educational service. Nothing shared through the Services constitutes securities brokerage, investment, tax, accounting, or legal advice, a recommendation to buy, sell, or hold any security, derivative, currency, or other financial instrument, an offer or solicitation to buy or sell any financial product, or an endorsement, recommendation, or sponsorship of any company, fund, security, or information source.
Our mentors, instructors, and staff are not registered as securities broker-dealers, investment advisors, or financial planners. Information shared is not intended to be the sole basis of any investment decision, and nothing should be construed as advice tailored to meet the needs of any particular investor. You should consult a licensed professional before making any trading or investment decision.
8. Trading Risks and User Responsibility
Trading futures, options, forex, cryptocurrencies, and other financial instruments carries a substantial risk of loss and is not suitable for every investor. Leverage can work against you as well as for you. You may lose some or all of your invested capital, and you should not trade with money you cannot afford to lose.
By using the Services, you acknowledge and agree that:
You bear full responsibility for your own research, trading decisions, and outcomes.
Past performance of any mentor, strategy, model, or indicator is not indicative of future results.
Hypothetical, backtested, or simulated results have inherent limitations and do not represent actual trading.
Lathyrus Trading does not assess, verify, or guarantee the adequacy, accuracy, or completeness of any information provided through the Services.
Lathyrus Trading does not guarantee the suitability, profitability, or potential value of any investment, strategy, or information source.
You waive all liability against Lathyrus Trading, its team, affiliates, and partners for any direct or consequential loss arising from your use of the Services or any other form of communication with us.

9. User Conduct and Community Rules
You agree to use the Services lawfully, respectfully, and in good faith. You will not:
Share, resell, redistribute, or publicly post paid content, recordings, lectures, trading models, or private Discord material.
Impersonate any member, mentor, instructor, or staff, or misrepresent your affiliation with Lathyrus Trading.
Harass, threaten, or discriminate against any member of the community.
Offer unsolicited financial advice, signals, or paid services to other members.
Upload or distribute malware, spam, pump-and-dump promotions, or other harmful content.
Attempt to reverse-engineer, scrape, or bypass access controls on any part of the Services.
Violation of these rules may result in a warning, suspension, or permanent termination of your account without refund.
10. Intellectual Property
All content provided through the Services — including lectures, videos, trading models, indicators, written materials, graphics, logos, and the Lathyrus Trading brand — is owned by Lathyrus Trading or its licensors and is protected by copyright, trademark, and other intellectual property laws.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to access and use the content solely for your own educational purposes during your active membership. You may not copy, reproduce, distribute, publish, publicly display, create derivative works from, or commercially exploit any content without our prior written consent.
11. Third-Party Services and Links
The Services rely on and integrate with third-party platforms, including but not limited to Whop (payments and membership), Discord (community), YouTube, TradingView, and various social media platforms. We are not responsible for the availability, content, policies, or practices of these third parties. Your use of any third-party service is governed by that third party's own terms and privacy policies.
12. Disclaimer of Warranties
The Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to merchantability, fitness for a particular purpose, non-infringement, accuracy, reliability, availability, or uninterrupted use. We do not warrant that the Services will be error-free, secure, or free of viruses or other harmful components.
13. Limitation of Liability
To the maximum extent permitted by applicable law, Lathyrus Trading, its owners, mentors, instructors, employees, affiliates, and partners shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages — including but not limited to loss of profits, trading losses, loss of data, loss of goodwill, or business interruption — arising out of or related to your use of the Services, even if advised of the possibility of such damages.
In no event shall our aggregate liability for any claim arising out of or related to the Services exceed the total amount you paid to Lathyrus Trading in the three (3) months preceding the event giving rise to the claim.
14. Indemnification
You agree to defend, indemnify, and hold harmless Lathyrus Trading and its affiliates, officers, mentors, instructors, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with your use of the Services, your trading decisions, your violation of these Terms, or your infringement of any rights of a third party.
15. Termination
We may suspend or terminate your access to the Services at any time, with or without notice, for any reason — including violation of these Terms, chargeback activity, abusive conduct, or at our sole discretion. Upon termination, your right to use the Services ends immediately. Sections that by their nature should survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and governing law — shall survive.
16. Changes to These Terms
We may update these Terms from time to time. The "Updated" date at the top of this page reflects the most recent revision. Material changes will be communicated via our website, Discord community, or email where appropriate. Your continued use of the Services after changes take effect constitutes acceptance of the revised Terms.
17. Governing Law and Dispute Resolution
These Terms are governed by and construed in accordance with the laws of [Jurisdiction TBD], without regard to its conflict-of-law provisions.
